2025 Nesto Apple AirPods Promotion (the “Promotion“)

This promotion is sponsored by Nesto Inc. (“Nesto”). 

Promotion Period. The period to which individuals can register for the Promotion starts on July 9th, 2025 at 08:00 am (EST) and ends on July 31st, 2025  at 11:59 pm (EST) (the “Promotion Period”).

Eligibility. To be eligible for the Promotion, the person (an “Eligible Participant”) must, at the time of participation, including when the Reward (as defined below) is awarded:

• be a legal resident of Canada;
• be the age of majority, or older, in their province/territory of residence; and
• have a Nesto mortgage in good standing.  

Qualifying Action. By being approved for a mortgage with Nesto during the Promotion Period and funding said mortgage with nesto, each Eligible Participant will automatically participate in the Promotion (a “Participant”).  

Reward. The reward (“Reward”) is  one (1) pair of Apple AirPods 4.

Other specifications of the Reward not outlined in these terms are subject to availability. Nesto is not responsible for any costs incurred in connection with the use of the Reward. The Reward is subject to change at any time, at Nesto’s sole discretion. Nesto also reserves the right, for any reason and in its sole discretion, to substitute and/or modify the Reward with another prize of equal or greater value. Limit of one (1) Reward per Participant.

If Nesto, in its sole discretion, suspects any fraudulent behaviour or attempt to game the promotion, including but not limited to misrepresenting information, submitting false documentation, artificially inflating mortgage amounts, or cancelling or withdrawing a mortgage application shortly after approval for the purpose of receiving the promotional reward, Nesto reserves the right to disqualify any Eligible Participant from participating in this promotion. Nesto may also take further action it deems appropriate, including but not limited to, withholding or reclaiming the retail value of the Reward or closing or suspending the Participant’s Nesto account. For greater certainty, only fully funded, legitimate mortgage applications that remain active for a reasonable duration (as defined by Nesto) will be eligible for this promotion. Transferring or re-submitting identical applications to trigger multiple rewards is not permitted.

The Reward is non-transferable, non-exchangeable, non-refundable, and has no cash surrender value. 

Currency. All currency shown in these terms and conditions are in Canadian dollars.

Delivery of Reward. The Reward will be delivered to the address specified by the Participant. The mailing address must be a Canadian mailing address and cannot be a P.O. box address. The Participant may incur shipping costs where the delivery location is outside of major metropolitan areas. No responsibility is assumed by Nesto once the Reward has been shipped. No responsibility is assumed for any delivery returned as undeliverable. The Participant bears all risks to the Reward upon delivery. Any unclaimed Reward, unresponsive communication, or Reward forfeiture will not be rewarded and has no cash value.

Tax Implications. There may be  tax implications to bonuses and rewards of this nature. Please consult with an accountant or tax professional for additional guidance. Nesto will not be issuing Participants a tax slip to report Reward issued. Participants are solely responsible for any required tax reporting.

Collection and Use of Personal Information. By participating in this Promotion, the Participant  understands and agrees that Nesto will collect and use their personal information for the purpose of administering this Promotion and in accordance with Nesto’s Privacy Policy, available here.

Release. By participating in the Promotion, the Participant  assumes all risk of injury, illness, disease, death, or any other damage which may arise in connection with their participation in the Promotion or receipt or use of a Reward. Without limiting the foregoing, the Participant hereby: (a) forever releases and discharges Nesto and its parent companies, subsidiaries, affiliates, related and associated entities and employees, directors, officers, suppliers, agents, sponsors and administrators of each (collectively, the “Releasees”), from and against any and all claims, actions, costs, liabilities, judgments, damages, obligations, losses, penalties, and expenses of any kind or nature whatsoever (including legal fees) (collectively, the “Claims”) in any way arising directly or indirectly out of any injury, loss, or damage that the Participant  may suffer as a result of, or in connection with the participation in the Promotion or any promotion-related activity, including the posting of any Reward in their Nesto account or the receipt or use of any Reward; and (b) indemnifies, defends and holds harmless the Releasees from and against any and all damages, loss and expenses, including legal fees, which may be suffered directly or indirectly by reason of the Participant’s  own negligence or willful misconduct during or in connection with their participation in the Promotion or receipt or use of any Reward. Any Claims (including without limitation and by way of example only, product liability claims or misleading advertising claims) related to a Reward should be directed to the Reward provider and not Nesto and without limiting the generality of the foregoing, the Participant  releases the Releases from all Claims and liabilities with respect to any and all Reward.

Apple. Apple, the Apple logo and AirPods are trademarks of Apple Inc., registered in the U.S. and other countries and regions.

General. Nesto reserves the right to cancel, amend, withdraw or restrict the Promotion at any time without notice. Nesto is the sole arbiter of these rules and any other issue arising under the Promotion. If Nesto suspects fraudulent or abusive behaviour, gaming of the system, inappropriate, offensive or derogatory language or information or a violation of these terms, as determined in Nesto’s sole and absolute discretion, Nesto reserves the right to remove all promotions from the Nesto account(s) and take any other action it deems appropriate including, but not limited to, removing the Reward.

An invitation to participate in this Promotion does not provide assurance that you will be accepted as a customer of Nesto. This Promotion is only valid for individuals in the location cited above that otherwise meet our eligibility requirements. 

The standard terms (https://www.nesto.ca/en/terms-of-use/) relating to the services provided by Nesto and any agreements that apply to the Participant continue to apply and are not affected in any way by this offer.

In the event of any discrepancy or inconsistency between the terms and conditions of the Promotion and disclosures or other statements contained in any related materials, including but not limited to the point of sale, print or online advertising, the terms and conditions of the Promotion shall prevail, govern and control.
